📄 JAPANアクスタ Terms of Use (Listing and Purchase)

Article 1 (Definitions)

1. "Buyer" means a person who purchases a product listed on the Service. Membership registration is not required to make a purchase.
2. "Seller" means a person who has become a member of the Company, has applied to list (register) a product on the Service through the procedure prescribed by the Company, and has received the Company's approval.
3. "Product" means an acrylic stand or similar item that the Company produces based on a Seller's images and designs.

Article 2 (Notes for Buyers)

1. You can purchase without registering as a member. Even if you register as a member, the same shipping fee structure (Yu-Mail, Nekopos and home delivery) applies as for purchases without registration. Free shipping for members applies to "Yu-Mail" only. JAPANアクスタ home delivery and Nekopos shipping are charged even for registered members.
2. Selling prices are shown on each product page (consumption tax included). Shipping fees are charged separately. For the latest shipping fees, please check the Notation Based on the Specified Commercial Transactions Act and each product page.
3. Payment may be made by credit card or bank transfer (prepayment). Production begins after we confirm your payment, and items are shipped in approximately 5 to 15 days (all estimated delivery dates are approximate and are not guaranteed).
4. Orders are accepted for delivery within Japan only. Products from JAPANアクスタ are delivered only to addresses in Japan. Delivery overseas (international shipping) is not available. We cannot accept orders whose delivery address is outside Japan.
5. Once you have reviewed your order and confirmed it, the order cannot be canceled. Because products are made 1 item at a time, we cannot accept returns or exchanges for customer-convenience reasons. If a product has a manufacturing defect, is damaged in transit, or is delivered incorrectly, please contact us within 8 days of its arrival. We will exchange it for a non-defective product or issue a refund.
6. The colors and finish of a product may differ slightly depending on your screen display and the shooting environment.

Article 3 (Seller Registration)

1. Only persons who are 18 years of age or older and who enter their registration information accurately may become Sellers. Registration by proxy is not permitted.
2. To register a listing, you must be a registered member and have purchased a registered product (acrylic stand) (an order for which payment has been confirmed). A listing cannot be registered with an unpaid order.
3. Registration details (nickname, catchphrase, shop name, selling price, etc.) will be published after review by the Company. If the Company determines that any content violates these Terms, laws or regulations, or public order and morals, the Company may refuse to approve the listing, suspend its publication, or request that the content be corrected or remove it.
4. If any registration details change, the Seller shall promptly notify the Company.

Article 4 (Selling Price, Revenue Share and Settlement)

1. The Seller selects the selling price from among the prices set by the Company.
2. Products with a selling price of ¥5,000 or more can be delivered by home delivery only (Yu-Mail and Nekopos cannot be selected). Only for products for which store pickup is set to "available," the Buyer may also choose "store pickup (delivery to the shop)," which sets the shop's address as the delivery address (this is treated the same as changing the delivery address; because the item is sent to the shop by home delivery, the home delivery fee applies).
3. The Seller's revenue share is calculated as "sales amount − (production cost of ¥770 (consumption tax included) + 18% of the sales amount)." The 18% includes credit card fees and bank confirmation fees. Shipping fees are borne by the Buyer and are not included in the revenue share. (For orders placed before 2026/10/8, the former rate of "base ¥660 + 10%" applies.)
4. Settlement is made monthly: the Company totals the sales for which payment has been confirmed and transfers the amount to the bank account registered by the Seller. The Company bears the bank transfer fee.
5. Orders that are canceled or refunded, and purchases made by the Seller personally (including the purchase of 1 item required as a condition of registration), are not eligible for revenue share.
6. The Seller shall register an accurate bank account in order to receive the revenue share. The Company is not responsible for non-delivery or delay caused by errors in the account information.
7. The Seller is responsible for reporting the revenue share as income and paying the applicable taxes.

Article 5 (Prohibited Acts)

Buyers and Sellers must not engage in any of the following acts.

1. Acts that violate laws and regulations, these Terms, or public order and morals
2. Acts that infringe the rights of the Company or a third party (copyright, trademark rights, portrait rights, privacy, reputation, etc.)
3. Posting or sending images or text that are obscene, violent, discriminatory, or otherwise offensive
4. Impersonating a real person or registering false information
5. Posting images or information of persons under 18 in a sexual or otherwise inappropriate context
6. Interfering with the operation of the Service, or using it through unauthorized access or other improper means
7. Any other act that the Company deems inappropriate

Article 6 (Warranty of Rights and Portrait Rights)

1. The Seller warrants that, for the designs, images, text, logos and other materials they register, they hold the rights or have obtained permission to use them from the rights holder, and that they do not infringe the rights of any third party.
2. The Seller grants the Company permission to use the registered content free of charge for the operation and promotion of the Service (including display on this site, in advertising, and on social media).
3. If the Company suffers damage as a result of a violation of the preceding paragraphs, the Seller shall be liable to compensate the Company for that damage (including attorney's fees).

Article 7 (Loss of Membership and Cancellation of Registration)

If a Seller violates these Terms, makes a false declaration, or is otherwise deemed unsuitable by the Company, the Company may cancel the registration, suspend publication, or revoke membership without prior notice. In this case, the Company may decline to settle any unsettled revenue share related to the violation.

Article 8 (Handling of Personal Information)

The Company will manage the personal information of Buyers and Sellers appropriately in accordance with its Privacy Policy. A Buyer's name, address and other details are used for shipping products and responding to inquiries, and are not disclosed to Sellers.

Article 9 (Disclaimer)

1. The Company does not guarantee that the Service will be available at all times or free of errors. The Service may be interrupted or suspended in whole or in part without prior notice due to failures of communication lines or computers, system maintenance, disasters, and the like.
2. The Company is not responsible for content posted by Sellers or for disputes between a Seller and a third party. However, this does not apply where the Company has acted intentionally or with gross negligence.
3. If a product does not reach the Buyer for reasons attributable to the Company, please contact us within 30 days of the order. We will refund the amount paid for the order.

Article 10 (Advertising)

1. Upon application by a Seller, the Company may display that Seller's listing as an "advertisement" for a certain period at a specific rank (2nd, 5th or 10th) in the genre-specific listing (the "Ad Slot"). A Seller who wishes to place an Ad Slot should contact the Company.
2. An Ad Slot will be placed only after the Company confirms the genre, rank, period and target listing and the Company accepts. The Company sets the Ad Slots, and multiple advertisements cannot be placed in the same genre, at the same rank, in the same period.
3. An advertising card is labeled "Ad," and a notice that the list includes advertisements is also shown above the list. During the display period, a listing designated as an advertisement is not shown at its original position in the order of newest arrivals, but at the designated rank. When the display period ends, the listing returns to its normal position in the order of newest arrivals.
4. Only listings that are registered in that genre and currently published can be designated as advertisements. While a listing is not published, such as when it is under review, unpublished (including suspension by an administrator), rejected, or withdrawn, it will not be displayed as an advertisement.
5. Advertising fees vary depending on the rank, period and season. The Company will provide a quotation for the fee in response to an inquiry, and when the Seller accepts it, the fee will be billed by an invoice issued by the Company. The approximate amount (minimum) used for quotations is posted under "Advertising Slot Information" in the Seller Guide. Advertising fees are billed separately from the revenue share under Article 4 and are not deducted from the revenue share.
6. If, for reasons attributable to the Company, an advertisement cannot be displayed during the agreed period, the Company will make an adjustment for the period not displayed, either by extending the display period or by refunding the fee. No fee will be refunded if the Seller withdraws or unpublishes the listing for their own convenience, or if publication is suspended for reasons attributable to the Seller.
7. The number of impressions and clicks on an advertisement, as measured by the Company, can be checked on the Seller's My Page. These figures are the Company's own approximations excluding bots and similar traffic, and do not guarantee views, purchases or sales resulting from the advertisement.
8. If the Company determines that the content of an advertisement may violate these Terms, laws or regulations, or public order and morals, or otherwise deems it inappropriate, the Company may stop displaying the advertisement or return the listing to its normal display without prior notice. The treatment of the fee in this case follows paragraph 6 (no refund if it is attributable to the Seller).

Article 11 (Changes to the Terms, Governing Law and Jurisdiction)

1. The Company may revise these Terms as necessary, and the revised Terms take effect from the time they are posted on this site.
2. These Terms are governed by the laws of Japan. If a dispute arises in connection with the Service, the Tokyo District Court shall be the exclusive agreed court of jurisdiction of first instance.
